Terms of Service

1. Acceptance of Terms

By accessing or using the Mortgage Magic platform (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you (and, where applicable, your employer or authorised firm) and Mortgage Magick Limited t/a Mortgage Magic™, a company registered in England and Wales (Company No: 12179889) (“Mortgage Magic”, “we”, “us”, or “our”).

2. Platform Access & Eligibility

To access the Platform, you must:

• Be a UK mortgage intermediary, financial adviser, mortgage broker, professional introducer, or finance professional
• Be at least 18 years of age
• Have the legal authority to enter into these Terms on your own behalf or on behalf of your firm
• Comply with all applicable regulatory requirements, including any FCA obligations applicable to your firm

Access by members of the general public is strictly prohibited. Mortgage Magic reserves the right to terminate access for any user who does not meet these eligibility requirements.

3. User Obligations

As a user of the Platform, you agree to:

• Provide accurate and complete information when creating your account
• Maintain the confidentiality of your login credentials and not share access with unauthorised persons
• Use the Platform only for lawful professional purposes in accordance with applicable regulations
• Not attempt to reverse engineer, decompile, or extract the source code of the Platform
• Not upload, transmit, or introduce any malicious code, virus, or harmful data
• Not use the Platform to process personal data in violation of UK GDPR or applicable data protection laws
• Comply with all FCA rules and regulations applicable to your use of the Platform
• Promptly notify Mortgage Magic of any suspected unauthorised access to your account

4. Technology Platform — No Advice

The Platform is a technology tool. Mortgage Magic is not authorised to provide, and does not provide, mortgage advice, financial advice, or any form of regulated recommendation.

All advice, recommendations, and regulated activities conducted using the Platform remain the sole responsibility of the authorised user and their FCA-authorised firm. The Platform supports your professional activities — it does not replace your regulatory responsibilities.

5. Subscriptions & Pricing

Platform access is provided on the subscription terms specified at the time of your order. All prices are quoted excluding VAT. You are responsible for payment of all applicable taxes.

Subscription fees are charged in advance on a monthly basis. Additional usage charges (credit reports, VOIP, SMS, WhatsApp) are charged on a pay-as-you-go basis and invoiced monthly in arrears.

Mortgage Magic reserves the right to change pricing with reasonable notice to existing subscribers. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

6. Intellectual Property

All intellectual property rights in the Platform, including software, design, trademarks, content, and documentation, are owned by or licensed to Mortgage Magick Limited. The Mortgage Magic name and logo are registered trademarks.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for your legitimate professional purposes during your subscription period. No other rights are granted.

You retain ownership of all data and client information you input into the Platform. You grant Mortgage Magic a limited licence to process this data as necessary to provide the Platform services.

7. Data Processing

Where you input personal data about your clients into the Platform, you do so as a data controller. Mortgage Magic acts as a data processor on your behalf in relation to such data.

A Data Processing Agreement (DPA) is available upon request and governs the processing of personal data by Mortgage Magic on your behalf. Your use of the Platform for client data processing constitutes acceptance of our DPA terms.

All personal data is stored on UK cloud infrastructure within the United Kingdom. Please refer to our Privacy Policy for full details of how we handle personal data.

8. Availability & Support

We aim to maintain high Platform availability but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. We provide email support to all users and enhanced support to paid subscribers as described in our support documentation.

9. Limitation of Liability

To the fullest extent permitted by law, Mortgage Magic's total liability to you in connection with the Platform, howsoever arising, shall not exceed the total fees paid by you in the 12 months preceding the claim.

Mortgage Magic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunity, or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10. Termination

Either party may terminate the subscription at any time on notice. Mortgage Magic may suspend or terminate access immediately if you breach these Terms, fail to pay subscription fees, or engage in conduct that Mortgage Magic reasonably considers harmful to the Platform or other users.

On termination, your access to the Platform will cease. You may request an export of your data within 30 days of termination. Following this period, data will be deleted subject to any legal retention obligations.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified to registered users with at least 30 days' notice. Your continued use of the Platform following the effective date of any changes constitutes acceptance of the revised Terms.
